Data processing notice for persons turning over materials to the archival repository of the Institute of National Remembrance – Commission for the Prosecution of Crimes against the Polish Nation.

Principles relating to the processing of personal data

Your personal data will be processed:

  1. For the purpose of transfer, storage, arrangement and safeguarding of archival materials illustrating the losses of the Polish nation in the years 1917–1990, donated or lent to the archival repository of the Institute of National Remembrance, in the case of your consent to the above;
  2. b) For purposes connected to the publication of archival materials donated or lent by you to the archival repository of the Institute of National Remembrance;
  3. c) For the purpose of publishing your picture in the context of providing information about you as the donor or lender and your archival materials in publications and exhibitions organized by the Institute of National Remembrance.

 

The legal basis for the processing of personal data is Article 6(1) b (your consent) and c (compliance with the legal obligation to which the data administrator is subject) of Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, on the protection of physical persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/WE (General Data Protection Regulation) – hereinafter GDPR as well as Art. 28 and Art. 29 of the Act on the Institute of National Remembrance – Commission for the Prosecution of Crimes against the Polish Nation.

 

The personal data controller is the President of the Institute of National Remembrance – Commission for the Prosecution of Crimes against the Polish Nation, with headquarters in Warsaw, address: ul. Janusza Kurtyki 1, 02-676 Warszawa. The personal data controller assures the appropriate technological, physical, administrative and procedural resources for the protection of your personal data and the assurance of its confidentiality, correctness and accessibility as well as its protection from unlawful access or use and prevention of a security breach of your personal data. Your personal data can be disclosed to parties authorized by the controller as well as to parties authorized to view it under separate legal provisions.

Provision of your personal data for the purposes stated in b) and c) above is voluntary.

Your personal data will be stored in agreement with the period stated in IPN-KŚZpNP’s material and physical file list, according to Art. 6 pt. 2 of the Act on the National Archival Repository and State Archives of 14 July 1983.

In the case of your consent to the processing of your personal data for the purposes stated in letter b) and c) above, it will be processed until you withdraw your consent and until the cessation of its publication on websites, in the media and on the official social media of the Institute of National Remembrance.

In the case of your consent to the creation of your personal data for the purposes listed in points b and c, your personal data will be processed until the moment you withdraw your agreement or until such publications on websites, media and official profiles of the Institute of National Remembrance on social (REPEATED BELOW?) media are concluded. You have the right to access to the contents of your personal data as well as the right to correct, remove or limit the processing of your personal data, the right to object to the processing of your personal data and the right to the transfer of your personal data.

If you discover that the processing of your personal data violates the GDPR you have the right to file a complaint to the President of the Personal Data Protection Office.

In the case of your consent to the processing of your personal data for the purposes stated in letter b) and c) above, you have the right to withdraw your consent. Withdrawal of your consent does not affect the legality of the processing of your personal data done prior to the withdrawal of your consent.

x – for the purpose of publication of archival materials donated or lent by me to the archival repository of the Institute of National Remembrance;

x – my picture for the purpose of providing information about me as the donor or lender and my archival materials in publications and exhibitions organized by the Institute of National Remembrance.

I declare that I have read and accept the principles relating to the processing of personal data of a donor or lender of archival materials to the archival repository of the Institute of National Remembrance – Commission for the Prosecution of Crimes against the Polish Nation.
